Does the Wayne County Treasurer’s Office owe you money?


If your property was foreclosed in March 2026 and sells in the upcoming auctions for more than the minimum bid amount, you may be eligible to claim any remaining, surplus proceeds from that sale. The Wayne County’s treasurer’s office has a process for you to claim surplus funds that may be available from that sale. The deadline to file is July 1, 2026

If you own the property or hold meaningful equity interest (such as a mortgagee or lienholder) in the property at the time of the 2026 foreclosure, Michigan law (MCL 211.78t) allows you to make a claim to collect surplus proceeds.

Here’s what to do next

  1. Download the Notice of Intent form using this QR on the next page or visit WayneCountyMI.gov/Treasurer and visit the “Claims and Auction” page
  2. Fill out the Notice of Intent form, including Application information, property information, and your interest in the property (title, mortgage, liens).
  3. Have the Notice of Intent form notarized (only sign the form in the presence of a notary)
  4. Submit the form to the Wayne County Treasurer’s Office
  • Hand-deliver or mail via certified mail to 400 Monroe St, Detroit, MI 48226, 5th Floor.
  • Deadline: July 1, 2026.

What happens after that?

  • If you file a claim by July 1, 2026, the Treasurer’s office will notify you by January 31, 2027, and you will receive Form 5744 (Notice to Claimant to File Motion with the Circuit Court) by mail.
  • Use Form 5744 to file a motion with the 3rd Circuit Court between February 1 and May 15 after the notice. The court will schedule a hearing to determine payments.
