{"id":3569,"date":"2020-07-03T16:10:12","date_gmt":"2020-07-03T20:10:12","guid":{"rendered":"http:\/\/yemeniamerican.com\/en\/?p=3569"},"modified":"2020-07-03T19:20:56","modified_gmt":"2020-07-03T23:20:56","slug":"american-moslem-society-sues-cemetery-for-power-play","status":"publish","type":"post","link":"https:\/\/yemeniamerican.com\/en\/american-moslem-society-sues-cemetery-for-power-play\/","title":{"rendered":"American Moslem Society Sues Cemetery for \u2018Power Play\u2019"},"content":{"rendered":"<p>By Simon Albaugh<\/p>\n<p>Dearborn, Mich. &#8211;\u00a0 In a lawsuit filed May 22, the American Moslem Society alleges that Woodmere cemetery has breached its contract with the Dearborn Mosque in an effort to agree on a more profitable contract for the cemetery. Filed in Michigan\u2019s Wayne County Circuit Court, the lawsuit will be seeking relief on a later date, according to the docket submitted by Steven Cohen, the Mosque\u2019s legal counsel.<\/p>\n<p>The original contract being disputed was agreed upon in 2017. It set the price of 1,000 graves for $625,000, which would be paid by the AMS Mosque over a 5-year period. At the beginning of the breach of contract, AMS had already paid $380,000 to Woodmere Cemetery. The lawsuit alleges that Woodmere cemetery would agree to allow the use of the burial sites if AMS Mosque paid more than what they owed before using any of the burial sites, or if they renegotiated the contract for roughly double the price of what was originally agreed upon.<\/p>\n<p>\u201cIt&#8217;s basically a power play to either generate some easy cash flow or sell the same graves at double the price,\u201d Mr. Cohen told the Yemeni American News.<\/p>\n<p>Leaders at the AMS Mosque held a press conference to discuss the details of the lawsuit. They talked about the relationship that Woodmere Cemetery has held with AMS Mosque for decades. Over the past 32 years, the AMS Mosque, and many other Mosques in the surrounding areas have been using the land through its original agreements.<\/p>\n<p>\u201cIn my 32 years,\u201d said Imam Mohammad Mardini. \u201cI buried many loved ones from our communities, from everyone from every background, all of them united here.\u201d<\/p>\n<div id=\"attachment_3571\" style=\"width: 381px\" class=\"wp-caption alignnone\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-3571\" class=\"wp-image-3571 \" src=\"http:\/\/yemeniamerican.com\/en\/wp-content\/uploads\/sites\/2\/2020\/07\/CDF378D5-0468-420F-B9FC-740BD2648CC5_1_105_c-300x200.jpeg\" alt=\"\" width=\"371\" height=\"247\" srcset=\"https:\/\/yemeniamerican.com\/en\/wp-content\/uploads\/sites\/2\/2020\/07\/CDF378D5-0468-420F-B9FC-740BD2648CC5_1_105_c-300x200.jpeg 300w, https:\/\/yemeniamerican.com\/en\/wp-content\/uploads\/sites\/2\/2020\/07\/CDF378D5-0468-420F-B9FC-740BD2648CC5_1_105_c-1024x683.jpeg 1024w, https:\/\/yemeniamerican.com\/en\/wp-content\/uploads\/sites\/2\/2020\/07\/CDF378D5-0468-420F-B9FC-740BD2648CC5_1_105_c-768x512.jpeg 768w, https:\/\/yemeniamerican.com\/en\/wp-content\/uploads\/sites\/2\/2020\/07\/CDF378D5-0468-420F-B9FC-740BD2648CC5_1_105_c.jpeg 1086w\" sizes=\"auto, (max-width: 371px) 100vw, 371px\" \/><p id=\"caption-attachment-3571\" class=\"wp-caption-text\"><em>The Lawsuit also alleges that the funeral plots that were bought by AMS Mosque are in a state of disrepair, despite an upkeep agreement in the original contract. <\/em><\/p><\/div>\n<p>&nbsp;<\/p>\n<p>Not only is this an important legal battle for the Muslim community, but this is also a protection of one of the most important tenants of the faith.<\/p>\n<p>\u201cThis is not just simply a concern for the American Muslim society this month, but is a community concern in general,\u201d said Executive Director of Michigan\u2019s chapter of the Council of American Islamic Relations Dawud Walid.\u201d<\/p>\n<p>\u201cBesides our community, suing Woodmere Cemetery for breach of contract, we also believe that they breached a Community Trust. For us as Muslims, our burial rights are sacred. It&#8217;s something that is very integral and very important, as far as our faith practice. So, not only is our Burial Rites something important, according to Islamic juris prudence, but the ability for us to bury our debt according to Islamic rituals in right is protected by the First Amendment of the Constitution of the United States of America.\u201d<\/p>\n<p>It\u2019s not about just finding a new cemetery, leaders say. Woodmere cemetery is a place where the Metro Detroit community has been burying members of its deceased Muslim neighbors for decades.
